These Terms of Service ("Terms") are between ReviGo Limited Liability Company, trading as ReviGo ("ReviGo", "we", "us"), and the person or organization identified in an accepted order ("Customer", "you"). They apply to ReviGo physical products, managed routes, subscriptions, analytics, support, and related services.
1. Documents that form the agreement
The agreement consists of:
- the accepted quote or order confirmation;
- these Terms;
- the Privacy Notice, Refund and Replacement Policy, Service Policy, Acceptable Use Policy, and Order Information page; and
- any later written amendment expressly accepted by both parties.
If documents conflict, a specifically negotiated written order term takes priority over a general policy for that order. Mandatory applicable law always takes priority.
2. Before an order becomes binding
ReviGo will provide a reviewable quote or order summary describing the product, customization, quantity, total price, payment, estimated delivery, service period, renewal, warranty, returns, and support. The Customer can request corrections before confirmation.
An enquiry is not a contract. An order becomes binding when ReviGo accepts the Customer's confirmation and any required payment or deposit is received. Electronic messages and recorded electronic confirmations may be used to form and evidence the agreement.
ReviGo may reject or withdraw a quote before acceptance. A purchase-order number, automated reply, payment screenshot, or Customer message does not by itself prove acceptance. ReviGo's recorded order confirmation controls unless the Customer promptly proves a clear recording error.
3. Authority and accurate information
A person confirming an order for a business states that they are authorized to do so. The Customer must provide accurate business, branch, contact, delivery, destination, design, and payment information and promptly correct a material error.
4. What ReviGo supplies
ReviGo supplies the physical products and services identified in the order. A typical service includes a programmed NFC product, an optional QR credential, a ReviGo-managed web route, connection to an approved destination, privacy-minimized operational analytics, and support during the paid service period.
Features not written in the accepted order are not included. Demonstrations, mockups, or estimates describe expected operation but do not create a guarantee beyond the final order and these Terms.
5. Prices, payment, and records
The Customer must pay the price, deposit, balance, delivery charge, and approved optional charges shown in the order. ReviGo will not add an undisclosed mandatory fee after acceptance. Unless the order says otherwise, amounts are stated in Libyan dinars.
ReviGo may delay production, delivery, activation, or renewal until a due amount is received. ReviGo keeps order and payment records and provides a receipt or payment confirmation. A requested written or electronic summary of the sales information will be provided within ten days after conclusion of the contract.
The Customer must raise a good-faith billing concern promptly and cooperate before initiating a payment reversal where direct resolution is reasonably available. An unjustified chargeback, reversed transfer, or failed payment does not cancel a valid debt and may result in suspension and recovery of reasonable, lawful collection costs.
6. Production and delivery
Production and delivery dates are reasonable estimates unless expressly guaranteed in the order. The Customer must provide a usable delivery address and cooperate with an agreed delivery or collection arrangement. ReviGo will communicate a material known delay.
If the ordered product or service becomes unavailable, ReviGo will notify the Customer promptly and, where applicable, no later than twenty-four hours before the agreed delivery time. The Customer may accept a reasonable substitute, a new date, or the refund required by the Refund and Replacement Policy and applicable law.
7. Activation and destinations
Activation requires an eligible public destination and completion of the agreed setup. ReviGo may test the route before delivery. The Customer is responsible for the destination's content, accuracy, ownership, permissions, security, availability, and compliance with law and platform rules.
ReviGo may refuse or pause a destination that appears unsafe, deceptive, unlawful, unauthorized, technically unsupported, or inconsistent with the Acceptable Use Policy. ReviGo does not become the publisher or owner of destination content by routing visitors to it.
8. Reviews and third-party platforms
ReviGo is independent from Google, Meta, TikTok, Snapchat, and other destination platforms unless expressly stated. ReviGo does not control their availability, policies, moderation, accounts, rankings, reviews, or content.
The Customer may request genuine feedback but must not buy, reward, pressure, selectively gate, fabricate, coordinate, or manipulate reviews. ReviGo does not guarantee any number of taps, reviews, ratings, followers, bookings, sales, or other commercial result.
8.1 Gateway, announcements, and promotions
Where enabled, a ReviGo gateway may collect a visitor's selected rating, show Customer-supplied information, and offer a route to another page. The Customer is responsible for ensuring its configuration, wording, offer, destination, eligibility conditions, stock, duration, and fulfilment are accurate, lawful, and consistent with applicable platform rules.
A gateway, campaign, announcement, or analytics option is a technical tool, not legal approval of the Customer's use. ReviGo may reject, alter, pause, or remove a configuration that creates legal, security, visitor-safety, or platform-compliance risk. Promotions must not be conditional on posting, changing, or removing a public review.
9. Service period and renewal
The order states the activation date or method for calculating it, minimum service period, expiry, and renewal cycle. Renewal is not automatic unless the Customer expressly accepts automatic renewal in writing or electronically. For manual renewal, a new period begins only after confirmation and any required payment.
ReviGo may send reminders but the Customer remains responsible for the confirmed renewal date. A route may stop redirecting when the paid period ends or payment is overdue. ReviGo does not guarantee indefinite reservation of an expired route.
10. Customer responsibilities
The Customer must:
- use ReviGo only for lawful business purposes;
- obtain rights to submitted names, logos, designs, profiles, and destinations;
- keep authorized-contact and destination details current;
- follow placement, care, security, and platform instructions;
- provide every legally required notice, consent, offer term, and customer remedy for its own content and campaigns;
- notify ReviGo promptly about a lost card, exposed credential, or suspicious destination; and
- avoid conduct prohibited by the Acceptable Use Policy.
11. Physical products and credentials
Ownership of fully paid physical cards transfers to the Customer unless the order says otherwise. ReviGo retains its software, domain, managed route, security credentials, templates, analytics system, and platform infrastructure.
A physical card must not be altered, copied, reassigned, or reprogrammed without approval. Lost, stolen, deliberately damaged, incorrectly installed, or unauthorized duplicated products may require paid replacement. A compromised credential may be disabled immediately.
12. Changes requested by the Customer
ReviGo may verify the requester before changing a destination, business assignment, card status, subscription, refund instruction, or ownership record. A change affecting price, production, delivery, or service scope requires a new written confirmation. ReviGo may charge only a disclosed and accepted additional amount.
13. Availability, maintenance, and support
ReviGo uses reasonable care to operate active managed routes and respond to incidents. Temporary interruption may result from maintenance, internet or mobile networks, hosting, databases, certificates, domain systems, third-party destinations, security response, or events outside reasonable control.
No fixed uptime or response-time commitment applies unless purchased in a separate written service level. ReviGo may make urgent changes needed to protect visitors, Customers, or infrastructure.
14. Analytics
Analytics are operational estimates, not audited advertising measurements. Repeated taps, browser behavior, previews, bots, connectivity, privacy tools, and classification limits can affect totals. ReviGo does not promise that every request will be recorded or that every recorded request represents a unique human visitor.
Unless an accepted order expressly states otherwise, analytics are supplied for internal operational guidance only and must not be represented as audited audience, advertising, accounting, tax, or sales records. The Customer remains responsible for independently verifying decisions that could create financial or legal consequences.
15. Privacy and confidentiality
ReviGo handles personal information as described in the Privacy Notice. Each party must use reasonable care with non-public business, security, and technical information received from the other and use it only for the agreement, support, security, or legal compliance.
Confidentiality does not cover information already public without breach, independently developed, lawfully received from another source, or required to be disclosed by law or a competent authority.
16. Intellectual property
Each party keeps its pre-existing intellectual property. The Customer grants ReviGo a limited, non-exclusive permission to reproduce submitted names, logos, designs, and destination information only as needed to quote, produce, deliver, support, and operate the order.
Unless separately agreed, no purchase transfers ReviGo source code, security methods, platform designs, templates, domains, or administration systems.
Feedback about ReviGo may be used to improve the service without identifying the Customer or disclosing its confidential information. ReviGo may use aggregated and de-identified operational information to operate, secure, analyze, and improve its services.
17. Warranty and remedies
ReviGo warrants that supplied products will materially match the accepted order when delivered and that services will be performed with reasonable care. If ReviGo is responsible for a verified defect or material non-conformity, the normal remedy is repair, reprogramming, replacement, re-performance, service credit, or refund as appropriate.
This warranty does not cover ordinary wear, misuse, unauthorized alteration, unsuitable placement, customer-supplied errors, or a third-party destination failure. It does not reduce a mandatory remedy under applicable law.
18. Limited liability
This section allocates financial risk. It does not remove a mandatory refund, replacement, compensation, or other right that applicable law does not allow ReviGo to limit.
ReviGo is responsible for direct loss that was reasonably foreseeable and caused by ReviGo's material breach of the agreement or failure to use reasonable care. ReviGo is not responsible to the extent loss was caused by the Customer, an unauthorized instruction, an inaccurate destination, misuse, failure to follow instructions, or a third-party platform or network outside ReviGo's reasonable control.
For a Customer acting for business purposes, and only to the extent permitted by law, ReviGo is not liable for indirect or consequential loss, lost profit, lost revenue, lost opportunity, lost anticipated savings, loss of goodwill, reputational harm, or loss of data that the Customer could reasonably have backed up.
For a Customer acting for business purposes, ReviGo's total aggregate liability for all claims arising out of or connected with an affected order, event, or series of related events during any twelve-month period is limited to the fees actually paid to ReviGo for the affected product or service in that period. Multiple claims, legal theories, claimants, cards, or incidents do not multiply that cap.
To the fullest extent permitted by law, the remedies expressly stated in the agreement are the Customer's exclusive contractual remedies. The Customer must take reasonable steps to prevent and reduce loss, promptly report a material problem, and give ReviGo a reasonable opportunity to investigate and remedy it before avoidable replacement costs are incurred.
The exclusions and cap above do not apply to:
- an express refund, repair, replacement, or re-performance obligation under these policies;
- fraud, fraudulent misrepresentation, deliberate misconduct, or gross negligence;
- death or personal injury caused by negligence;
- a breach of confidentiality or personal-data responsibility where the law does not permit limitation; or
- any other liability that applicable law says cannot be excluded or limited.
19. Customer responsibility for third-party claims
To the extent permitted by law, the Customer will defend, reimburse, and hold ReviGo harmless from reasonable third-party claims, penalties, losses, and costs caused by the Customer's content, destination, promotion, instructions, legal or platform violation, infringement of rights, fraud, deliberate misuse, or material breach of the Acceptable Use Policy. ReviGo will notify the Customer and allow reasonable participation in the defence. This responsibility applies only to the extent caused by the Customer and does not cover ReviGo's own fault.
20. Suspension and termination
ReviGo may pause or terminate a route for expiry, non-payment, unsafe or unlawful use, false material information, credential compromise, serious security risk, or material breach. Where practical, ReviGo will give notice and a reasonable opportunity to correct the issue. Immediate action may be taken where delay could cause harm.
The Customer may end future manual renewals at any time. Ending an active fixed period does not automatically create a refund, but the Refund and Replacement Policy and mandatory rights continue to apply. On termination, public routing may stop and outstanding amounts remain due.
21. Events outside reasonable control
Neither party is responsible for delay caused by an event it could not reasonably prevent, including widespread network failure, government action, natural disaster, conflict, major provider outage, or similar force majeure. The affected party must take reasonable steps to reduce the impact and resume performance. This does not excuse payment already due or a refund required when performance becomes unavailable.
22. Changes to terms or service
ReviGo may update policies for future orders and renewals. ReviGo will not materially reduce an active fixed-period service or impose a new price during that period without the Customer's agreement, except for a change reasonably required by law, safety, security, or a third-party dependency.
Material changes will be communicated where reasonably practical. If a change materially disadvantages the Customer and is not legally or technically necessary, ReviGo will offer a reasonable remedy or right to end the affected future service.
23. General legal terms
These Terms are governed by the laws applicable in Libya. The parties should first try to resolve a dispute in good faith. An unresolved dispute may be submitted to the competent Libyan authorities or courts.
If one term is unenforceable, the remaining terms continue. A delay in enforcing a right is not a waiver. The Customer may not transfer the agreement without ReviGo's written approval, which will not be unreasonably withheld. ReviGo may use responsible suppliers but remains responsible for its contractual duties. No third party receives a contractual right unless the agreement expressly says so.
Notices may be sent to the latest verified electronic or physical contact supplied by a party and are treated as received when delivery is recorded, subject to proof of failure. Clauses concerning payment, intellectual property, confidentiality, privacy, liability, third-party claims, dispute resolution, and records survive termination where their purpose requires it. Headings are for convenience and do not limit meaning.
